R v Franklin (1883) 15 Cox CC 163

The appellant threw a box into the sea off Brighton Pier. The box struck a swimmer who died as a result of being hit.

Held:

For constructive manslaughter there must be an unlawful act. The unlawful act must constitute a criminal offence. It is not sufficient that the act committed is against civil law.
