Murray Bull & Co Ltd v Murray [1953] 1 QB 211  Court of Appeal

The defendant was the managing director of the claimant company which engaged in chemical research. He was granted a lease of a flat in the company's premises which had access to the street but also direct access to the company’s offices and laboratory.

Held:

This was not a service occupancy since the defendant was not required to live in the flat by the terms of his employment. He lived there as a matter of convenience.
