Donnelly v Jackman [1970] 1 All ER 987
A policeman tapped the defendant on the shoulder in order to gain his attention. The defendant then assaulted the policeman. He was charged with assaulting an officer in the course of his duty. The defendant contended the policeman's actions amounted to a battery.
Held:
The policeman's actions did not amount to a battery.
